Disabling Labeling: The WTO Consistency of the Indonesian Mandatory Halal Labeling Law

On May 2016, Universitas Pelita Harapan Center for International Trade & Investment (UPH-CITI) released a working paper by Michelle Limenta, Bayan Edis, and Oscar Fernando titled “Disabling Labeling: The WTO Consistency of the Indonesian Mandatory Halal Labeling Law.” It examines Indonesia’s 2014 Halal Act, arguing that while it aims to uphold religious freedom, its mandatory labeling and certification requirements may violate WTO rules under the TBT Agreement due to their broad scope, discriminatory impact on imports, and excessive trade restrictions. The authors recommend clarifying the law, simplifying procedures, and aligning with international halal standards.
